Tim Evans

Tim Evans is a Senior Associate at Bird & Bird in London. His practice focuses on Bankruptcy and Insolvency Law, with extensive experience in both transactional and contentious insolvency law.

He advises insolvency practitioners, directors, lenders and creditors on formal insolvency processes, including Administration, Liquidation and Receivership, across various sectors such as retail, manufacturing and cryptocurrency.

In particular, he has extensive experience acting on Administration appointments and negotiating business and asset sales, having acted on both the Administrator and buyer side. He also regularly advises directors of financially distressed companies on their statutory duties, and provides guidance to secured lenders on the validity and priority of their security and their enforcement options in the context of borrower default. He also advises insolvency practitioners in respect of their statutory duties, including regarding creditor approval and reporting obligations.

His contentious experience includes both presenting and opposing winding-up petitions, as well as bringing technical applications under the Insolvency Act on behalf of Administrators, including those under paragraphs 71 and 107 of Schedule B1. He has acted for office holders in pursuing claims regarding antecedent transactions, in particular regarding preferences and transactions at an undervalue, and has acted beneficiary side in defending preference claims.

He also has experience in energy sector distress, having been seconded to Ofgem's consumer energy team, advising with a focus on the supplier of last resort process. Throughout his career, he has worked across a variety of sectors, including energy, retail, manufacturing, leisure and hospitality, social care and cryptocurrency.
